Terms & Conditions

Stock-Guard™ is a trading name of The Polytunnel Guys LTD.

All orders placed by customers with Stock-Guard™ and all sales of goods by Stock-Guard™ are subject to the Terms and Conditions below.

Stock-Guard™ has the right to alter any of these Terms and Conditions from time to time and any alterations will apply to orders received after that time.

Ordering

Online orders submitted shall not be deemed accepted by Stock-Guard™ until confirmed by the Stock-Guard™ (e-mail).

Prices

Stock-Guard™ reserves the right to alter the price of goods at any time before delivery to reflect any increase in cost to Stock-Guard™, any change in delivery details or quantities, or any delay caused by the customer.

All online prices are exclusive of VAT.

Payment can be made by any method specified on the Stripe Checkout page of our website. Stock-Guard™ will take all reasonable precautions to keep the details of your order and payment secure, but Stock-Guard™ cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

Payment of the total order price, together with the delivery charge, will be debited from the customer’s account after the Stock-Guard™ Order Confirmation notification has been sent to the customer, but prior to the goods being delivered.

Where Stock-Guard™ invoices the customer, payment of the invoice is due within 30 days from the date of invoice. Any late payment attracts interest at the rate of 2% per month. After 31 days, customers whose accounts remain unpaid will have their credit facilities suspended and no further goods will be supplied.

Any discount which is offered subject to payment by a specific date may be withdrawn if payment is not received by that date.

Stock-Guard™ endeavour to ensure that all online prices are correct, however errors may occur. In the event of Stock-Guard™ discovering an error in the price of the goods ordered by the customer, Stock-Guard™ will inform the customer as soon as possible and give the customer the option of reconfirming the order at the correct price or cancelling the order.

If the customer’s card issuer fails to make any payment of the price or any delivery charge on behalf of the customer, Stock-Guard™ shall be entitled to cancel the order or suspend any further deliveries.

Customers who fail to pay for goods supplied within an agreed timescale will be liable for all costs incurred by Stock-Guard™, including collection costs and legal costs.

In the case of goods for export, the customer shall be responsible for complying with any legislation or regulations governing the importation of goods into the country of destination and for the payment of any duties on the goods.

Delivery

Details of delivery and delivery charges are specified on the Delivery page of our website.

Stock-Guard™ make every effort to deliver goods within the estimated timescales, however delays or increased timescales may occur during the busy season.

Stock-Guard™ can estimate a date for delivery of goods, but customers shall understand that it is an estimate. Stock-Guard™ shall not be liable for any loss caused to the customer as a result of failure to deliver by the estimated delivery date or such other date or time as may be subsequently agreed.

Customers must inform Stock-Guard™ if there are any specific instructions with regards to delivery, for example if the delivery address may be difficult for the courier to find. Stock-Guard™ shall not be liable for any loss caused to the customer as a result of failure to provide such instructions.

Customers have the opportunity to inform Stock-Guard™ if they would like the goods to be left with a neighbour or in a secure location, etc. If customers request for goods to be left unsigned for, it is vital that they leave a signed note/message on the outside of the property which the driver can take for the courier/delivery company’s records. Stock-Guard™ shall not be liable for any missing items or any defect of the goods arising from wear and tear, wilful damage, or accident due to the customer’s request for goods to be left unsigned for.

Stock-Guard™ will endeavour to accommodate any special delivery requests, however customers shall understand that Stock-Guard™ cannot guarantee a specific date or time for delivery. Goods are delivered by a national courier and Stock-Guard™ recommend that customers are at the delivery address for the duration of the day on the day of expected delivery.

Reasonable access for large and heavy goods vehicles must be available for unloading of the goods. If special arrangements need to be made due to inadequate access, Stock-Guard™ must be informed prior to dispatch of the goods and Stock-Guard™ reserve the right to charge the customer any necessary additional delivery costs.

If the customer fails to take delivery of the goods or fails to provide Stock-Guard™ with adequate delivery instructions prior to dispatch of the goods, Stock-Guard™ reserve the right to store the goods until delivery can be made and charge the customer storage costs.

Stock-Guard™ always endeavour to deliver a complete order, however on occasions when items are out of stock, Stock-Guard™ will dispatch these items by the standard delivery method as soon as the items are available. Stock-Guard™ shall not be liable if this causes delay to the customer’s construction of the structure.

Missing Items or Items Damaged in Transit

All parcels must be checked by customers prior to signing the delivery note (unless customers have given special instructions that goods can be left in a secure location unsigned for). If there is any damage to the goods or if items are missing, this must be stated on the delivery note where possible and must reported to Stock-Guard™ within 3-days of the date of delivery. If notification is not made within 3-days of the date of delivery, Stock-Guard™ will not be able to make a claim with the courier/delivery company. Stock-Guard™ shall not be liable for any missing items or any defect of the goods arising from wear and tear, wilful damage, or accident as a result of any request by the customer that goods are to be left unsigned for.

Stock-Guard™ shall not be liable for any defect of the goods arising from fair wear and tear, wilful damage, accident, negligence, acts of God, use otherwise than as recommended by Stock-Guard™, failure to follow the manufacturer’s instructions, or any alteration or repair carried out without the approval of Stock-Guard™

Returns of The Easy-Clip Range of windbreaks will only be accepted if damaged or defective upon arrival. Stock-Guard™ Accepts no responsibility for wrongly sized items whereas the customer has failed to supply the correct information. Damage or defective items should be reported within 3 days of delivery.

Any decision by customers that they wish to return the goods for any reason must be notified to Stock-Guard™ within 14-days of delivery. If you do not notify us of your claim within 14-days, you shall not be entitled to reject the goods.

Stock-Guard™ shall make a full refund of the total price of the sale to the customer so long as the goods are returned to the trading address below in their original condition and packaging within 14-days of the delivery date. All goods shall be returned at the customer’s expense.

Defective Items

Any claim by the customer that goods are defective must be notified to Stock-Guard™ as soon as possible after delivery or, where the defect was not apparent at the time of delivery, within 3-days of discovery of the defect. Claims must be made to Stock-Guard™ writing and with accompanying photographs. If the customer fails to notify Stock-Guard™ of the claim within a reasonable time period after delivery, the claim will be rejected and Stock-Guard™ shall not be liable for any defect or failure.

Upon receipt of the claim, Stock-Guard™ shall arrange inspection of the goods and if the claim is to be upheld Stock-Guard™ can either arrange for collection and replacement or refund the value of the defective item.

Stock-Guard™ endeavour to ensure all our products are of the highest possible quality, however Stock-Guard™ shall not be liable for any claim that exceeds the value of the defective item or the total invoice value.

Liability

Stock-Guard™ shall not be liable for any defect of the goods arising from use otherwise than as recommended Stock-Guard™ failure to follow the manufacturer’s instructions, or any alteration or repair carried out without the approval of Stock-Guard™, including goods purchased from Stock-Guard™ for the use in building second-hand windbreaks

When customers place an order or register on our website, certain information is required, including name, e-mail address, telephone number, billing address, delivery address, and credit/debit card details. Stock-Guard™ works in partnership with Stripe to provide high levels of security to ensure confidential and sensitive information is not compromised.

Stock-Guard™ may use the information that you provide for customer, market and product assessment and analysis, for the prevention and detection of fraud, and for any prize draws or competitions customers enter.

Stock-Guard™ may disclose your information to anyone to whom Stock-Guard™ transfers or may transfer our rights and duties under our agreement with the customer, and/or if Premier Polytunnels has a duty to do so or if the Law allows us to do so.

Risk

Risk of damage to or loss of the goods passes to the customer at the time of delivery or if the customer wrongfully fails to take delivery of the goods.

The ownership of the goods shall not pass to the customer until Stock-Guard™ has received in full the total order price and delivery charge.

Until such time as the goods passes to the customer (and provided the goods are still in existence and have not been resold Stock-Guard™ shall be entitled at any time to require the customer to deliver up the goods to Stock-Guard™. If the customer fails to deliver up the goods, Stock-Guard™ shall be entitled to enter upon any premises of the customer or any third party where the goods are stored and repossess the goods.

The customer shall not be entitled to pledge or in any way charge by way of security for any indebtedness any of the goods which remain the property of Stock-Guard™. If the customer does so, all monies owing by the customer to Stock-Guard™ shall become due and payable.

Customer’s Right to Cancel

If you are a consumer, as defined in the Consumer Protection (Distance Selling) Regulations 2000, you have the right to cancel your contract with Stock-Guard™ at any time up to the end of 7 working days after you receive the goods.

To exercise your right to cancel, you must give written notice to Stock-Guard™.

If you exercise your right to cancel after the goods have been delivered to you, you will be responsible for returning the goods to Stock-Guard™ at the trading address below at your own expense. The goods must be returned in their original condition and packaging, and with the order number enclosed. You must ensure that goods are not damaged while on your premises or in transit.

Once you have notified Stock-Guard™ that you are cancelling the contract, Stock-Guard™ will refund or recredit you within 30-days for any sum that has been paid by you to Stock-Guard™ or debited from your credit/debit card.

If you do not return the goods as directed, Stock-Guard™ may charge you for the cost of recovering the goods.
